PolitiFact | In gun policy address, Joe Biden exaggerates about background checks at gun shows

  • If you go to a gun show and buy a firearm from a federally licensed seller, you will have to pass a background check, just as if you went to a bricks-and-mortar gun store. You would only escape a background check at a gun show if you bought from a seller who isn’t federally licensed.
  • While the data is incomplete, federally licensed sellers have been found to make up a substantial share, and perhaps a majority, of gun show vendors.
In a Rose Garden event, President Joe Biden announced several actions his administration will take to address what he called an “epidemic” of gun violence.

Biden repeated his call for Congress to pass legislation to expand background checks. The House voted largely along party lines to pass a pair of background check bills this year, but they haven’t moved forward in the Senate.

“These bills, one, require background checks for anyone purchasing a gun at a gun show or an online sale,” Biden said at the April 8 event. “Most people don’t know it, you walk into a store and you buy a gun, you have a background check. But you go to a gun show, you can buy whatever you want, and no background check.”

When it comes to background checks for gun purchases, what matters is who sells the guns, not where the guns are sold — and when a federally licensed seller is a vendor at a gun show, they have to run a background check just as they would if they were back at a bricks-and-mortar gun store.

The White House told PolitiFact that Biden wasn’t suggesting that every gun transaction at a gun show would take place without a background check. Instead, he meant that sales without background checks could occur in some cases.

However, that’s not what he said.

What the laws say about sales at gun shows

Advocates for stricter gun control measures often talk about the “gun show loophole,” though some observers say the term is a misnomer. The phrase itself doesn’t explain who is and isn’t required to run background checks at gun shows.

Federal law requires that people in the business of dealing in firearms be licensed by the federal government.

Specifically, the law says that a license is required if “a person who devotes time, attention, and labor to dealing in firearms as a regular course of trade or business with the principal objective of livelihood and profit through the repetitive purchase and resale of firearms.”

The law specifically rules out a required license if a person “makes occasional sales, exchanges, or purchases of firearms for the enhancement of a personal collection or for a hobby, or who sells all or part of his personal collection of firearms.”

This can sometimes be a fuzzy distinction, but it means many sellers of guns do need to have a license.

“Every federally licensed retailer, whether they are selling a gun at a brick and mortar store, a  gun show or the sale starts online,” must complete a signed background check form from the U.S. Bureau of Alcohol, Tobacco and Firearms and get approval from the FBI’s National Instant Criminal Background Check system, said Mark Oliva, a spokesperson for the National Shooting Sports Foundation.

Biden’s Real Goal: Forced, Universal Unionization – DickMorris.com at DickMorris.com

Biden has explicitly stated that the Davis-Bacon Act requiring union wages and companies will govern the expenditure of federal construction money under the infrastructure bill. This includes just short of $2 trillion on building roads, bridges, airports rewiring and re-insulating private buildings and schools, renovating the electric power grid, replacing old water system pipes, building charging stations for electric cars and all manner of other construction. With that amount of money, no company can resist unionization if that is what is required to get in on the gravy train.

Schumer: Senate will act on marijuana legalization with or without Biden – POLITICO

Senate Majority Leader Chuck Schumer really likes to talk about weed.

Schumer has been making waves on cannabis policy since he first introduced a bill to legalize marijuana in April 2018. It was part of his pitch for voting Democrat in the 2020 election, and now — with the majority in hand — he is putting together new federal marijuana reform legislation with Sens. Cory Booker (D-N.J.) and Ron Wyden (D-Ore.).

This week, Schumer’s home state of New York legalized marijuana use for adults, after years of failed efforts. More than 40 percent of Americans now live in states that have embraced full legalization.

President Joe Biden has been a conspicuous outlier among Democrats when it comes to supporting marijuana legalization. But Schumer said Biden’s reticence won’t deter the Senate from taking aggressive action to loosen federal restrictions.

AOC was one of least effective members of Congress: study

She’s the queen of Twitter — but less successful at lawmaking.

Rep. Alexandria Ocasio-Cortez was among the least effective members of the last Congress according to a new survey from the nonpartisan Center for Effective Lawmaking — a joint project of Vanderbilt University and the University of Virginia.

AOC introduced a total of 21 bills which the center defined as “substantive” — but that is where the story ends. Her legislation received no action in committees, no floor votes, and none ever became law, according to the center, which takes its data from Congress.gov.

“She introduced a lot of bills, but she was not successful at having them receive any sort of action in committee or beyond committee and if they can’t get through committee they cannot pass the House,” Alan Wiseman, a Vanderbilt political scientist and co-director of the center, told The Post.

“It’s clear that she was trying to get her legislative agenda moving and engage with the lawmaking process,” Wiseman added “But she wasn’t as successful as some other members were — even among [other] freshmen — at getting people to pay attention to her legislation.”

When looking at the legislative effectiveness of all congressional Democrats, AOC was ranked 230th out of 240 Democrats. Among the 19 Dem lawmakers from New York state, she ranked dead last.

Sharon Osbourne in great spirits after exit from ‘The Talk’

Sharon Osbourne appeared in great spirits Tuesday as she was spotted for the first since her contentious departure from “The Talk,” which a source told us left her with a multimillion-dollar payout.

On her way into lunch at the Sunset Marquis hotel in Hollywood, Osbourne gave a thumbs-up to a videographer who asked her how she’s doing. The former host then threw up the peace sign and appeared to smile underneath her face mask when asked if everything was good.

For the outing, Osbourne, 68, opted for a classic look that included a loosely-fitted black suit and white shirt accessorized with pearls.

Osbourne exited the CBS talk show on March 26 following accusations of racism.

“Sharon is walking away with a $5 to $10 million minimum payout and was able to spin that it was her decision [to leave the show],” a source previously told Page Six.

A separate source added that, under her departure agreement, Osbourne is free to tell her side of the story.

“Sharon will talk when she is ready,” the source said. “She still wants to give her side of the story. She has been on that show for 11 years and knows all the secrets.”

AOC says calling border crisis a ‘surge’ pushes white supremacy

Rep. Alexandria Ocasio-Cortez has finally addressed the border crisis — but only to accuse anyone using the term “surge” of pushing a “white supremacist” philosophy.

Ocasio-Cortez (D-NY) has repeatedly been accused of ducking the dangerously overcrowded migrant detention centers despite saying they were akin to “concentration camps” under the previous administration.

She initially appeared outraged when asked during an Instagram Live ask-me-anything session why she was “not addressing the border crisis and the kids in cages like you used to” — asking after a pause, “Are you for real?”

“It’s not a border crisis. It’s an Imperialism crisis, it’s a climate crisis, it’s a trade crisis. And also it’s a carceral crisis,” she said, without directly addressing the kids-in-cages allegation itself.

Katie Couric Goes Makeup-Free for PEOPLE’s Beautiful Issue | PEOPLE.com

When Katie Couric was first asked to go makeup-free for PEOPLE’s annual Beautiful Issue, she had an instant gut reaction.

“Are you out of your mind? Hell no,” the award-winning journalist remembers. But after some thought, the 64-year-old star decided, “Why not?”, and stripped down to her natural, makeup-free self.

“Doing a shoot without makeup, makes you feel both liberated and vulnerable,” Couric tells PEOPLE. “You feel great because you’re being true to who you are and how you look. It’s a huge dose of reality! On the other hand, let’s face it, people feel prettier when they have some makeup on that enhances their features. So I think doing a shoot like this requires a lot of trust.”

If You Have This Blood Type, Your Risk of a Stroke May Be Higher

There are many factors that can put you at an increased risk of having a stroke —and blood type may be one of them, a new study says.

At the American Stroke Association’s (ASA) 2021 International Stroke Conference, research funded by the National Institute of Neurological Disorders and Stroke looked at the association between blood type and stroke risk. According to the study, the researchers found that non-O blood types (A, B, or AB) may be at an increased risk of early-onset stroke for women who smoke and take oral contraceptives.

The researchers looked at nearly 350 women who had experienced a stroke before the age of 50 and compared their data to 383 women who had not had a stroke. They concluded that women with non-O blood types who smoked and took oral contraceptives were nearly twice as likely to have a stroke before turning 50.

Sharon Osbourne is out of ‘The Talk’ – CNN

(CNN)“The Talk” and Sharon Osbourne have parted ways, CBS announced Friday.

The news comes two weeks after controversy over an on-air confrontation between Osbourne and one of her co-hosts, as well as allegations that she had made racist and homophobic remarks about her colleagues in the past.

“The events of the March 10 broadcast were upsetting to everyone involved, including the audience watching at home. The Effects of Alcohol to an Aging Brain Can’t Be Undone | Well+Good

he impact of alcohol on your body changes as you age. While some differences are immediately recognizable (a terrible hangovers after one drink the night before, for example), others are a bit more subtle. “The effects of alcohol on the brain are dependent on age and daily consumption habits,” says Dr. Willeumier. “With aging, specific structural and functional changes happen in the brain, including thinning of the cerebral cortex, neuronal shrinkage, decreased spine density, decreased white-matter connectivity, and diminished neurotransmitter production.” Alcohol consumption only exacerbates symptoms of brain aging.

Dr. Willeumier cites an August 2020 neuroimaging study, published in the journal Nature Scientific Reports. Researchers looked at 353 participants age 39 to 45 who underwent an MRI and used neurological and neuropsychiatric assessments to find that moderate alcohol consumption (fewer than three drinks per day for females, four drinks per day or less for males) was associated with a smaller brain volume. An October 2008 neuroimaging study, published in JAMA Neurology, looked at 1,839 participants age 33 to 88 and found that higher levels of alcohol consumption were associated with smaller brain volume.

White House might tax motorists by the mile to fund infrastructure plan

The Biden administration is considering imposing a vehicle mileage tax on Americans — as a way to fund a multi-trillion-dollar infrastructure plan set to be announced by President Biden, Transportation Secretary Pete Buttigieg said Friday.

“I think that shows a lot of promise… If we believe in that so-called user-pays principle, the idea that part of how we pay for roads is you pay based on how much you drive,” Buttigieg said on CNBC during an interview.

“The gas tax used to be the obvious way to do it; it’s not anymore… So, a so-called vehicle miles traveled tax or a mileage tax, whatever you want to call it, could be the way to do it.”

The levy would tax drivers on the number of miles they travel, as opposed to the amount of gasoline they consume, which is no longer a reliable stream of income with so many electric cars on the road.

Lib News Article Claims We May Be Living in a ‘Permanent Pandemic’

We’ve now endured a year of life-disrupting measures due to the coronavirus pandemic, which the country — and world — has adapted to. Sadly, it appears as though our own social lockdown measures created needless death and despair.

The cure was worse than the problem.

If you ask one Bloomberg columnist, who formerly worked as a columnist for The Economist, the nightmare will never end– and why should it? Everything is bad and sad and most definitely hopeless, despite the fact that states across the country are rolling back restrictions with great success.

Andreas Kluth, who writes opinions for the left-wing publication, argued Wednesday, “We must start planning for a permanent pandemic,” and he cited the emergence of these supposedly deadly new viral “variants” we keep hearing so much about.

“For the past year, an assumption — sometimes explicit, often tacit — has informed almost all our thinking about the pandemic: At some point, it will be over, and then we’ll go ‘back to normal,’” Kluth wrote. “This premise is almost certainly wrong.”

Fox News hit with $1.6 billion lawsuit over election fraud claims

Dominion Voting systems, one of the largest election equipment manufacturers in the U.S. and the subject of false conspiracy theories by conservative figures, has sued Fox News for $1.6 billion.

The suit highlights the number of times Fox News segments contained false claims that Dominion equipment was used to rig the 2020 election, that it was tied to the late Venezuelan President Hugo Chavez, or that it paid off U.S. government officials.

“Fox took a small flame and turned it into a forest fire,” the 441-page lawsuit reads. “As the dominant media company among those viewers dissatisfied with the election results, Fox gave these fictions a prominence they otherwise would never have achieved. With Fox’s global platform, an audience of hundreds of millions, and the inevitable and extensive republication and dissemination of the falsehoods through social media, these lies deeply damaged Dominion’s once-thriving business.”

A Fox spokesperson said in an email that “FOX News Media is proud of our 2020 election coverage, which stands in the highest tradition of American journalism, and will vigorously defend against this baseless lawsuit in court.”

WATCH – Secret Service reportedly got involved in bizarre gun case involving Hunter Biden ⋆ The Savage Nation

The New York Post:

The Secret Service intervened in an investigation into a 2018 incident involving Hunter Biden and his girlfriend at the time and former sister-in-law, Hallie, in which she took his gun and tossed it into the trash thinking he was going to kill himself with it, according to a report.

When she returned to retrieve the gun, it was gone, Politico reported on Thursday.

Police in Delaware launched an investigation in case the gun, left in a trash can across from a high school, had been used in a crime, the report said.

But Secret Service agents contacted the owner of the store where Hunter bought the gun and asked to take the paperwork recording the sale, Politico reported.

The owner, Ron Palmieri, at first balked at the request, suspecting they were attempting to hide Hunter’s ownership of the gun, but then ultimately complied and turned over the documents to the Bureau of Alcohol, Tobacco, Firearms, and Explosives, the government agency that oversees federal gun laws.

The Secret Service said it has no record of agents investigating the incident and said President Joe Biden was not under protection at the time.

Then, several days later, the gun was returned by a man who searches trash cans for recyclables.

Boulder Shooting Suspect Makes First Court Appearance : NPR

The suspect in the Boulder, Colo. grocery store shooting that left 10 people dead made his first appearance in court Thursday, in a brief hearing that called for a mental health assessment. Last night, hundreds of people gathered to mourn the victims and support those affected by the senseless gun violence.

Ahmad Al Aliwi Alissa, 21, is facing 10 counts of murder in the first degree and one count of attempted murder over the horrific attack at a King Soopers supermarket. The victims include a police officer who responded to calls for help. The ages of those who died range from 20 to 65.

Alissa appeared in court alongside his attorney, Kathryn Herold of the Colorado Public Defender’s Office. Alissa wore a white face mask and what looked to be a purple hospital gown. Because of an injury to his leg, the suspected gunman was seated in a wheelchair.

“Our position is that we cannot do anything until we are able to fully assess Mr. Alissa’s mental illness,” Herold told the court as she requested a delay. She did not go into detail about what that illness might be.
